Judge Payne rules for Rambus!

ORDER

Having reviewed the documents delivered to the Court in camera pursuant to instructions given in a telephone conference with counsel on July 20, 2005, which documents are more particularly identified in a letter to the Court dated July 25, 2005 from counsel for Rambus Inc., with the attachment thereto, it is hereby ORDERED that:

(1) the Clerk is directed to file, on the left side of the file, the letter addressed to the Court and dated July 25, 2005 with its attached letter to Brian C. Riopelle, Esquire, counsel for Rambus Inc., also dated July 25, 2005;

(2) the Clerk is directed to file separately, and under seal, the documents therein referred to so that they will be available for further reference;

(3) having found that none of the documents submitted in camera pertain to the pending motion to transfer venue, it is hereby ORDERED that Rambus Inc. shall not be required to produce to Samsung Electronics Co., Ltd., for purposes of addressing the motion to transfer, any of the documents that were delivered to the Court in camera;

(4) nothing in this Order shall foreclose Samsung Electronics Co., Ltd. from seeking access to, the documents delivered to the Court in camera in further proceedings in this or any other Court.

The Clerk is directed to send a copy of this Order to all counsel of record by facsimile and regular mail.
