Forget about judicial economy. Turn the page. Go golfing. Whatever.
The fabric of American society is stitched together, in part, by the threads of justice. Justice as seen by the man on the street is not science. It is a belief, yes faith, that Lady Justice will not peek around her blindfold when dispensing justice. When that faith is gone, society edges ever closer to anarchy.
It is undisputed that Judge Payne made mistakes in his handling of the case Ramboids know as VAI - CAFC told the world.
Reasonable minds can differ, but a significant number of reasonable minds believe that Judge Payne made mistakes in VAII and that if Rambus had been willing to take VAII to CAFC and risk stalling its litigation elsewhere, CAFC would have again told Judge Payne to try again.
RMBS settled with IFX and that was the end of that saga . . . well, not exactly.
Samsung, decided to file its complaint against Rambus in Judge Payne's neighborhood. (Looks like forum shopping to this donkey.) Judge Payne accommodated Samsung and denied Rambus' motion to transfer the case to California and Judge Whyte's courtroom.
Reasonable minds can differ about the legal soundness of that decision. However, a significant number of reasonable minds wonder why Judge Payne was so upset at Rambus for not wanting to face Samsung in his courtroom. Does he expect that Rambus should simply "turn the other cheek" and let him slap Rambus around some more?
It can be argued that Judge Payne's desire to take judicial notice of a portion of the record from VAII in the Samsung v Rambus case is an exercise of judicial economy. Unfortunately, that argument is lost in a chorus of voices who believe that justice is not available to Rambus in Judge Payne's court room.
The validity of those voices is not the subject of this post. What is important is that those voices are increasing in numbers and gaining strength.
Judge Payne can do the most for Lady Justice by gathering the Samsung and Rambus lawyers in his chambers and telling Samsung that he will not entertain another amendment to their complaint.
I respectfully suggest Judge Payne should send them West.
Perception is reality and the perception of many is that Lady Justice is peeking . . . can the black helicopters be far behind?

IMO payne is the designated hit-man for the very lucrative racket of offering protection services for many large companies in serious legal trouble.
Many of payne’s actions were criminal in my layman’s opinion but I also realize it wasn’t easy for him to protect the cartel execs and lawyers from what they had done and are still doing to Rambus. Even though the cartel may have spent who knows how many millions of dollars on protection racket services over the years, payne and the politicians of VA have taken a lot of risks and worked hard for their protection services.*****
