The recent patch of grass from Samsung takes Rambus to task for employing attorney Neil Steinberg. Samsung claims that Rambus knew Steinberg was employed by Samsung under a written contract to serve as in-house counsel.
Mr. Steinberg is no stranger to litigation. Late in 1997 Samsung and Fujitsu Microelectronics were trading infringement lawsuits. Steinberg, then working for Samsung, is quoted as saying that Samsung will “aggressively defend” against the suit that has “no basis in law of fact.” Reads familiar?
Allegedly, Rambus liked the tough talk and skills of Mr. Steinberg so much that it made him an offer that was too good. So good, that Mr. Steinberg was willing to breach his contract with Samsung and violate his duty of loyalty to his client Samsung.
Ramboids will remember Steinberg as a tough talker. A September 2000 article in Electronic News credits Neil Steinberg, then vice president of IP at Rambus of warning that “memory makers who fought Rambus in court would pay more for licensing fees.”
According to this website, Neil Steinberg is a bright guy having earned a B.S. in Electrical Engineering, with honors, from Rochester Institute of Technology and then a JD, cum laude, from Suffolk University Law School. Also,
Mr. Steinberg is a Registered Patent Attorney, admitted to practice before the U.S. Patent and Trademark Office. He is a member of the Commonwealth of Massachusetts and District of Columbia Bars, and the Bar of the Court of Appeals for the Federal Circuit.
Mr. Steinberg remains busy helping clients obtain patents.
Samsung wants to depose Mr. Steinberg.
