Judge Whyte granted Hynix relief from his Order of 1/19/05 granting Rambus summary judgment as to certain claims. Read the Order at Rambus Investor Relations.
Hynix argued that certain terms were not in dispute at the Markman hearing and as a result, it did not bring arguments of non-infringement on these terms. Rambus opposed reconsideration of the summary judgment Order on procedural grounds. Judge Whyte stated in his Order Granting Relief that “the court prefers that issues be resolved on the merits” and stated that “Rambus may move for summary judgment of infringement based upon the inclusion of these limitations in Hynix’s accused devices.”
In English . . . the long list of Rambus’ patent claims that Judge Whyte previously found by summary judgment that Hynix has infringed was shortened a few claims. As to the claims removed from the long list, Hynix can argue at trial that Hynix is not infringing. As to those same claims, Rambus can make a new motion for summary judgment before trial and attempt to move the claims back to the long list and prevent them from being argued in the trial.
